These Website Terms and Conditions (“Terms”) govern your visit, access, and use of the website located at https://corporatecompliance.in (the “Platform”) and any advisory, facilitative, audit, or value-added compliance services offered by the Company.
By accessing, browsing, or registering on the Platform, you (“User”, “you”, or “your”) explicitly acknowledge that you have read, understood, and unconditionally agreed to be bound by these Terms, along with our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease using the Platform.
1. Nature of Services & Disclaimer of Government Affiliation
- Independent Entity: The Platform is operated as a private, independent corporate compliance advisory service. We are NOT a government agency, nor are we affiliated, associated, endorsed by, or officially connected with the Employees' Provident Fund Organisation (EPFO), the Ministry of Labour and Employment, or any other government department, board, or statutory authority.
- Strictly Advisory & Facilitative: Our services are strictly advisory, technological, and facilitative in nature. We assist users in auditing passbooks, organizing documentation, drafting corrective representations (such as Joint Declarations), and tracking portal procedures. We do not possess executive, statutory, or administrative authority to approve, expedite, alter, or override decisions made by the EPFO or any third-party institution.
2. Eligibility & User Representations
- Age Requirement: You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872. If you are acting as a guardian on behalf of a minor, you represent that you possess the necessary legal authority to do so.
- Accuracy of Information: You represent and warrant that all data submitted by you—including Universal Account Numbers (UAN), passbook transcripts, establishment records, contact numbers, and identity credentials—are true, accurate, complete, and belong lawfully to you.
3. Consent to Fetch and Process Data (EPFO & KYC)
- EPFO Data Access: You hereby grant explicit, irrevocable consent to the Company to fetch your EPFO passbook data, establishment details, and claim histories via official channels and published APIs (such as APISetu or authorized aggregators) for the scope of rendering compliance services to you.
- Storage of Sensitive Information: You consent to the secure storage of your KYC records and operational data for the duration required to complete your active service or as long as your account remains active, in compliance with applicable Indian data protection frameworks.
- Redaction Notice: In alignment with privacy protection standards, sensitive government identity numbers are strictly minimized, masked, or handled under stringent secure tokenization protocols.
4. Limitation of Liability & Exclusion of Warranties
- “As Is” Basis: The Platform and its advisory tools are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.
- No Guarantee of Timelines or Outcomes: Because EPFO processing queues, regional office verification steps, and third-party employer responses (such as Joint Declaration approvals or exit-date updates) are entirely outside our operational control, the Company does not guarantee any specific processing timeline, claim approval, or legal outcome.
- Indemnification: You expressly agree to hold harmless, defend, and indemnify the Company, its directors, employees, and partners from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your misuse of the Platform, breach of these Terms, or reliance on third-party actions/delays.
5. Intellectual Property
All software, underlying source code, user interfaces, text, graphics, logos, and proprietary workflows displayed on the Platform are the sole property of the Company or its licensors. Unauthorized copying, reproduction, modification, scraping, or reverse engineering of any portion of the Platform is strictly prohibited.
6. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed by, interpreted, and construed in accordance with the laws of India.
- Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
- Arbitration: All disputes, controversies, or claims shall be referred to and finally resolved by arbitration conducted by a sole arbitrator appointed by the Company, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be New Delhi, India, and proceedings shall be conducted in English.
